These Terms of Use (“Terms”) govern your access to and use of the website located at scotiakennel.com and any related pages, content, and features made available by The Scotia Kennel (collectively, the “Site” and “Services”). The Site is owned and operated by The Scotia Kennel (“The Scotia Kennel,” “we,” “us,” or “our”), located in Grants Pass, Oregon.
By accessing or using the Site, you (“you” or “user”) acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not access or use the Site.
1. Eligibility and Acceptable Use
You must be at least 18 years of age, or the age of majority in your jurisdiction, to use this Site or to submit any information through it. By using the Site, you represent and warrant that you meet this requirement.
You may use the Site for lawful purposes only. You agree not to use the Site in any manner that: violates any applicable law or regulation; infringes the rights of any third party; is fraudulent, deceptive, harassing, defamatory, or harmful; attempts to gain unauthorized access to the Site, its servers, or any connected systems or networks; introduces malware, viruses, or other harmful code; or interferes with the proper functioning, security, or integrity of the Site.
2. Changes to These Terms
We reserve the right to modify, amend, or replace these Terms at any time in our sole discretion. Any changes are effective immediately upon posting the revised Terms to the Site, with an updated “Last Updated” date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
3. Description of the Site
The Site is an informational website about The Scotia Kennel, our German Wirehaired Pointers, our breeding program, and related content. Through the Site we share information and provide links to, among other things: our dogs and litters; a waitlist for prospective puppy families, which you join by emailing us; our podcasts, including Pure Dog Talk and The Marty and Laura Show; educational programs and on-demand series such as Pedigrees2Pups; a Club Partner Program and other services for breeders, exhibitors, and clubs; patron and membership support; and recommended third-party brands and products.
We do not sell products or services, operate a checkout, or process payments on the Site itself. Purchases, enrollments, memberships, and similar transactions take place on Pure Dog Talk or on third-party websites, as described in Section 6, and are subject to the terms of those platforms or sellers. We reserve the right to add, modify, suspend, or discontinue any portion of the Site at any time, with or without notice, and we will not be liable to you or any third party for doing so.
4. Waitlist, Puppy Inquiries, and No Sale by Website
This Section is important; please read it carefully.
Joining our waitlist, submitting an inquiry, exchanging communications with us, or any other interaction through the Site does not create any contract for the sale, reservation, or guarantee of a puppy, and does not obligate The Scotia Kennel to sell, place, or reserve any animal for you. Placement on the waitlist confers no right, priority, or entitlement to any specific puppy, litter, or timeframe.
The Scotia Kennel breeds rarely and places every puppy at our sole discretion, based on our assessment of the suitability of each home. We reserve the right to decline any inquiry or application, and to remove any person from the waitlist, at any time and for any reason, without obligation to provide a reason.
Any actual placement, sale, or transfer of a puppy or dog will be governed exclusively by a separate written purchase, placement, or co-ownership agreement signed by both parties. In the event of any conflict between these Terms and such a separate signed agreement regarding a specific animal, the separate signed agreement controls as to that transaction. No statement, photograph, description, or representation on the Site constitutes a term of any such agreement, an offer to sell, a warranty, or a guarantee of health, temperament, conformation, titles, or performance.
5. No Professional, Veterinary, or Breeding Advice
All content on the Site, including articles, podcasts, videos, breeder and exhibitor resources, and any health, nutrition, training, or breeding information, is provided for general informational and educational purposes only. It is not professional, veterinary, medical, legal, or financial advice, and it is not a substitute for the independent judgment of a licensed veterinarian or other qualified professional who has examined your animal and is familiar with your particular circumstances.
Statements made by guests, hosts, contributors, or third parties featured on the Site or in our podcasts are their own and do not necessarily reflect the views of The Scotia Kennel. You are solely responsible for any decisions you make or actions you take based on content found on the Site. Always consult a qualified professional before making decisions regarding the health, breeding, or care of any animal.
6. Offerings Available Through Pure Dog Talk and Third Parties
The Site promotes and links to offerings that are provided and sold elsewhere, not on the Site. Courses and on-demand educational series (such as Pedigrees2Pups), memberships, patron support, and the Club Partner Program are offered, sold, and delivered through Pure Dog Talk. Any purchase, enrollment, billing, automatic renewal, cancellation, or refund for those offerings is governed solely by the terms, conditions, and policies presented on Pure Dog Talk at the time of purchase, and not by these Terms. Likewise, recommended third-party brands and products are sold by third-party sellers on their own websites under their own terms. We do not process payments or fulfill orders on the Site.
7. Affiliate Relationships and Recommended Brands
The Site may feature recommended brands, products, services, and discount codes. Some of these are affiliate or sponsored relationships, meaning The Scotia Kennel may earn a commission, fee, or other compensation if you purchase through our links or codes, at no additional cost to you. We recommend only brands and products we believe align with our values, but we make no representation or warranty regarding any third-party product or service, and we are not responsible for any third party’s goods, services, fulfillment, or conduct. Any purchase you make from a third party is solely between you and that third party.
8. Intellectual Property
All content on or associated with the Site, including audio and video materials, podcasts, photographs, text, graphics, logos, designs, interfaces, and software (collectively, “Content”), is owned by The Scotia Kennel or its licensors and is protected by copyright, trademark, and other intellectual property laws of the United States and other countries.
You are granted a limited, personal, non-commercial license to access and view the Content as intended through the ordinary functionality of the Site. You may not, directly or indirectly: copy, reproduce, download, stream-capture, store, archive, republish, distribute, transmit, display, perform, sell, rent, license, or otherwise exploit any part of the Content; remove or alter any copyright, trademark, or other proprietary notice; or create derivative works based on the Content, except as expressly authorized in writing by The Scotia Kennel. We reserve all rights not expressly granted.
9. Trademarks
“The Scotia Kennel,” “Scotiadawgs,” “Pure Dog Talk,” “The Marty and Laura Show,” “Pedigrees2Pups,” and associated names, logos, and slogans are trademarks or service marks of The Scotia Kennel or their respective owners. Other trademarks, service marks, and logos appearing on the Site are the property of their respective owners. Nothing on the Site grants, by implication, estoppel, or otherwise, any license or right to use any trademark without the prior written permission of its owner.
10. User Submissions, Reviews, and Testimonials
If you submit, post, or transmit any content to us or to our social media pages, including reviews, testimonials, comments, photographs, messages, or other materials (“User Submissions”), you represent and warrant that: you own or have all necessary rights to the User Submission; the User Submission does not infringe or violate the rights of any third party, including copyright, trademark, privacy, or publicity rights; and the User Submission is not unlawful, defamatory, harassing, obscene, or otherwise objectionable.
By making a User Submission, you grant The Scotia Kennel a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly display and perform, and create derivative works from the User Submission in any media now known or later developed, including for marketing and promotional purposes, without compensation or further notice to you. We are not obligated to monitor, use, or retain any User Submission, and we may remove or refuse any User Submission at our discretion.
11. Copyright Complaints (DMCA)
We respect the intellectual property rights of others. If you believe that material available on the Site infringes your copyright, you may send a written notice to our designated agent that includes: a description of the copyrighted work you claim has been infringed; the location on the Site of the allegedly infringing material; your contact information; a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf; and your physical or electronic signature. Notices may be sent to The Scotia Kennel at laura@puredogtalk.com. We may remove allegedly infringing material and terminate the access of repeat infringers in appropriate circumstances.
12. Third-Party Links and Content
The Site may contain links to, or content from, websites and services not operated or controlled by The Scotia Kennel, including Pure Dog Talk, social media platforms, podcast and video hosts such as YouTube, brand partners, and other third parties. We provide these links and references for your convenience only. We do not control, endorse, or assume responsibility for the content, accuracy, privacy practices, products, or services of any third-party site or service. Your use of any third-party site or service is at your own risk and subject to that third party’s terms and policies. The inclusion of any link does not imply our endorsement of, or affiliation with, the linked party.
13. Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect information you provide or that we collect through the Site. By using the Site, you consent to the practices described in the Privacy Policy.
14. Disclaimer of Warranties
THE SITE, THE SERVICES, AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SCOTIA KENNEL EXPRESSLY DISCLAIMS ALL WARRANTIES AND REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
THE SCOTIA KENNEL DOES NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, COMPLETE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR ACCESS TO AND USE OF THE SITE, SERVICES, AND CONTENT IS AT YOUR OWN RISK.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE SCOTIA KENNEL, OR ITS OWNERS, MEMBERS, AFFILIATES, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, HOSTS, CONTRIBUTORS, AND LICENSORS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO: YOUR USE OF OR INABILITY TO USE THE SITE, SERVICES, OR CONTENT; ANY THIRD-PARTY CONTENT, PRODUCT, SERVICE, LINK, OR CONDUCT; ANY ERRORS, OMISSIONS, OR INACCURACIES IN THE CONTENT; OR ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; EVEN IF THE SCOTIA KENNEL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE SCOTIA KENNEL ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). BECAUSE SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS OF LIABILITY, SOME OF THE ABOVE MAY NOT APPLY TO YOU, AND OUR LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW. Nothing in these Terms limits liability that cannot be limited under applicable law.
16. Indemnification
You agree to indemnify, defend, and hold harmless The Scotia Kennel and its owners, members, affiliates, and their respective directors, officers, employees, agents, contractors, hosts, contributors, and licensors from and against any and all claims, liabilities, losses, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to: your use or misuse of the Site, Services, or Content; your User Submissions; your violation of these Terms; or your violation of any law or the rights of any third party.
17. Termination
We may suspend or terminate your access to all or part of the Site or Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, the rights and licenses granted to you under these Terms will end, and you must cease all use of the Site and Content. Any provisions that by their nature should survive termination will survive, including the sections on Intellectual Property, User Submissions, Disclaimer of Warranties, Limitation of Liability, Indemnification, Dispute Resolution, and General Provisions.
18. Dispute Resolution; Arbitration; Class Action Waiver
Please read this Section carefully, as it affects your legal rights.
Informal resolution: before initiating any formal proceeding, the party raising a dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site, Services, or Content (a “Dispute”) must first send a written notice describing the Dispute to laura@puredogtalk.com, and the parties shall attempt in good faith to resolve the Dispute informally for thirty (30) days from the date of that notice.
Arbitration: except as otherwise required by applicable law, any Dispute not resolved informally shall be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its applicable rules then in effect, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. The arbitration shall take place in or near Grants Pass, Oregon, or be conducted remotely, at the arbitrator’s discretion. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
Class action waiver: to the fullest extent permitted by law, all Disputes shall be brought in each party’s individual capacity only, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any form of class proceeding.
Opt-out: you may opt out of this arbitration and class-action-waiver agreement by sending written notice to laura@puredogtalk.com within thirty (30) days of first accepting these Terms. Your notice must include your name and a clear statement that you wish to opt out. If you opt out, the Governing Law and Venue section below will apply to any Dispute.
19. Governing Law and Venue
These Terms and any Dispute are governed by the laws of the State of Oregon, without regard to its conflict-of-laws principles. To the extent any Dispute is not subject to arbitration, you agree that it shall be brought exclusively in the state or federal courts located in Oregon, and you consent to the personal jurisdiction and venue of those courts.
20. Notices
We may be required by law to provide you with certain notices. You agree that we may provide notices to you by posting them on the Site or by sending them to any email address you provide to us, and that such notice is effective upon posting or sending. You are responsible for keeping any contact information you provide accurate and current; if you fail to do so, The Scotia Kennel is not responsible for any resulting failure to reach you.
21. General Provisions
These Terms, together with the Privacy Policy and any separate signed agreements referenced herein, constitute the entire agreement between you and The Scotia Kennel regarding the Site and supersede all prior or contemporaneous understandings. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision. If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms freely. The section headings are for convenience only and have no legal effect.
